Onewheel Lawsuit and Settlement Lawyer for Nosedive Injuries

Onewheel lawsuits claim that the electric skateboards unexpectedly shut off. The abrupt stop causes nosedives and sudden, often violent, ejections from the board. These malfunctions have caused numerous accidents and injuries, including traumatic brain injuries.

How Much Could You Get in a OneWheel Settlement?

While a class action lawsuit would divide a Onewheel settlement evenly between all claimants, an MDL considers each claimant’s unique circumstances and injuries.

Each Onewheel accident is different and results in different injuries and damages, so it’s difficult to say how much you might get in a settlement. However, the types of damages that claimants typically might recover in a product liability lawsuit include:

  • Medical treatment and expenses
  • Lost income
  • Pain and suffering

What Is the Onewheel Electric Skateboard?

Onewheel (sometimes mistakenly written as One Wheel) is made by Future Motion Inc. The self-balancing electric skateboard features a single, large wheel at its center, powered by a rechargeable battery.

Riders control the Onewheel skateboard by:

  • Shifting their body weight
  • Leaning forward to accelerate
  • Leaning backward to slow down
  • Applying pressure on toes or heels to turn.

The electric skateboard features an integrated smartphone app. This lets users monitor real-time data such as speed, battery life, total miles ridden, and more.

Models like the Onewheel Pint X boast published maximum speeds of up to 18 miles per hour.

Fun Meets Risk: What Causes Onewheel’s Sudden Stops and Nosedives?

Several factors contribute to the unexpected shutdowns and nosedives experienced by Onewheel riders:

Pushback Failure

The Onewheel is designed to provide “pushback”—a subtle lifting of the board’s nose—to alert riders when approaching operational limits such as maximum speed or low battery. However, instead of receiving this warning, riders often experience an abrupt shutdown, causing the board to nosedive instantly.

Variable Influences

Conditions such as rider weight, tire pressure, wind direction, battery level, riding stance, and terrain incline or decline can unpredictably affect the device’s performance. These variables make it nearly impossible to anticipate when a malfunction might occur.

Battery Depletion Issues

As the battery nears depletion, the Onewheel should signal riders through significant nose elevation. Unfortunately, in many cases, the device shuts off without adequate warning, leaving riders off-balance and vulnerable to crashes.

These defects prompted a recall of Onewheel electric skateboards.

Recalled Onewheel Skateboards

Every model of Future Motion’s Onewheel skateboards has been recalled, including:

  • Onewheel®
  • Onewheel+®
  • Onewheel+ XR®
  • Onewheel Pint®
  • Onewheel Pint X®
  • Onewheel GT®

These devices pose a significant risk of severe injury or death.

Consumer Product Safety Commission (CPSC) Warnings

On November 16, 2022, the United States Consumer Product Safety Commission (CPSC) issued a stark warning. The agency aimed to warn consumers to stop using all Onewheel products because of significant ejection hazards.

The commission highlighted Future Motion’s refusal to conduct an acceptable recall despite acknowledging the risks associated with their devices. The CPSC’s statement emphatically urged consumers to stop their use of their Onewheel skateboards. The warning also advised consumers not to buy Onewheel electric skateboards to prevent further injuries.

Future Motion’s Response

Future Motion’s CEO responded to the CPSC’s warning by publicly disputing the claims in a statement on TikTok. The company stated that the CPSC did not find any issues with Onewheel devices. They also said the products are not considered dangerous—they are just misunderstood.

A company spokesperson stated, “The federal agency is attempting to dismantle our business… we respectfully decline [the recall request].”

September 2023 Onewheel Recall

Following continued reports of injuries and fatalities, Future Motion eventually agreed to support a comprehensive recall in September 2023. This recall affected approximately 300,000 Onewheel units. According to the recall, exceeding Onewheel’s operational limits could result in the device’s failure to balance the rider, leading to severe crashes.

This delayed response has raised significant concerns, especially for individuals injured between the initial and subsequent CPSC announcements. People have criticized the prolonged availability of the defective product, which could impact settlement amounts of legal claims.

Types of Injuries From OneWheel Accidents

The CPSC reported dozens of accidents linked to electric skateboards, including four fatalities between 2019 and 2021. Other incidents involved severe injuries such as:

Is There a Onewheel Class Action Lawsuit?

Future Motion lawsuits have surged in the wake of safety issues with the company’s Onewheel skateboard.

Victims across the nation have reported severe injuries resulting from sudden stops and nosedives while using the Onewheel. An increasing number of victims have filed lawsuits in federal courts. This upswell led to the consolidation of these cases into a class action multidistrict litigation (MDL) in California.

This consolidation allows for coordinated pretrial proceedings and streamlined discovery processes. Selected bellwether cases will undergo trial to assess liability and damages, providing a framework for potential global settlement agreements that aim to compensate all affected individuals adequately.
